El rol de la corte internacional de justicia en la instauración de los derechos humanos como estrategia de universalización

El presente trabajo indaga en ciertas sutilezas discursivas utilizadas por la Corte Internacional de Justicia en sus sentencias y opiniones consultivas respecto de los derechos humanos. A partir del concepto de “estrategia de universalización” usado por Koskenniemi, se identifica la existencia de sucesivos vocabularios hegemónicos en la historia del derecho internacional y se postula “derechos humanos” como uno de ellos. Con el fin de explorar cómo se ha consolidado ese discurso dentro del orden normativo y las consecuencias de ello, se analiza el rol ejercido por el mencionado tribunal durante el período 1945-1991.
