Abstract

Availability has traditionally been predicated regarding on legal assets,
so that certain assets would be essentially unavailable to the owner.
Starting from the verification of the problem facing the traditional conception to explain the unavailability of certain individual rights, this work
proposes a conception of availability that allows to harmonize its basics with
the exercise of certain legal rights within the framework of a democratic
State o Law.
